- 💸Waived portion is taxable at your slab rate under Section 56(2)(x)
- 🧾Bank does NOT deduct TDS — you self-declare in your ITR
- 📊Rs 3 lakh waiver = Rs 60K-90K extra tax at 20-30% slab
- 📅Tax due in the FY when settlement letter is signed
📌 Example calculation
- Original outstanding
- Rs 5,00,000
- Settled at
- Rs 2,00,000 (40%)
- Taxable waiver
- Rs 3,00,000
- If slab rate 30%
- Extra tax: Rs 90,000
- Effective cost
- Rs 2,90,000 not Rs 2L
📖 Section 56(2)(x) in plain English
The Income Tax Act treats a bank forgiving your loan as if the bank gave you money. That "gift" is added to your taxable income under "Income from Other Sources" and taxed at your slab rate — the same as your salary would be. This has been law since 2017 (originally Sec 56(2)(vii), now (x)).
🛡️ Planning to soften the blow
- 🗓️Time the settlement to a low-income year — if you're between jobs, the waiver falls in a lower slab
- 💰Use 80C investments to offset — ELSS, PPF, insurance premiums reduce taxable income
- 📝Keep the settlement letter as proof — you'll need it for both ITR and if IT asks questions
❓ Common questions
📊How is the taxable waiver calculated?
Taxable waiver = Original outstanding minus settlement amount paid. Example: Rs 5 lakh outstanding, settled at Rs 2 lakh → Rs 3 lakh is added to your taxable income under 'Income from Other Sources' for that financial year.
💸Does the lender deduct TDS on the waiver?
No — banks don't withhold tax on written-off amounts. You have to self-declare it in your ITR filing. Failure to declare can trigger a Section 143(1) notice + interest under 234B/234C.
🧾How do I report it in my ITR?
Under 'Income from Other Sources' schedule. Add the waived amount as 'Other Receipts'. Keep the settlement letter + bank waiver confirmation as supporting documents.
📅In which financial year is the tax due?
The financial year in which the settlement letter was signed and the waiver became final — not when EMIs stopped. Get the exact date from your Full-and-Final Settlement letter.
